Terms of Service

1. Acceptance of Terms

By accessing or using the Kael API services at www.kael.ink ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Kael API provides a collection of developer tool APIs including but not limited to: QR code generation, UUID generation, hashing, encoding/decoding, JSON/YAML conversion, web screenshots, DNS lookup, code execution, text processing, and other utility endpoints. The Service is provided via RESTful HTTP APIs and an MCP (Model Context Protocol) server.

3. API Keys and Accounts

Access to the Service requires an API key, obtainable by registering with a valid email address.
You are responsible for maintaining the confidentiality of your API key.
You may not share, sell, or transfer your API key to third parties without our consent.
We reserve the right to revoke API keys that violate these Terms.

4. Service Tiers and Pricing

The Service offers multiple tiers:

Anonymous: Limited access without an API key (10 requests/minute).
Free: Registered API key with standard rate limits (30 requests/minute, 500/day).
Pro: Enhanced limits (120 requests/minute, unlimited daily). Paid subscription.
Unlimited: Maximum access with priority support. Paid subscription.

Pricing is subject to change. Active subscribers will be notified at least 14 days before any price increase takes effect on their subscription.

5. Acceptable Use

You agree NOT to:

Use the Service for any illegal, harmful, or fraudulent activity.
Attempt to circumvent rate limits, authentication, or security measures.
Use the Service to attack, scan, or probe other systems or networks.
Submit malicious code, payloads, or content designed to exploit the Service.
Resell or redistribute the Service without authorization.
Generate excessive load intended to degrade the Service for other users.

6. Payments and Refunds

Paid subscriptions are processed by our Merchant of Record, Creem (Armitage Labs OÜ). By purchasing a subscription:

You agree to Creem's Terms of Service for payment processing.
Subscriptions renew automatically unless cancelled before the renewal date.
Refund requests may be submitted within 7 days of purchase by contacting kael@kael.ink.
Creem handles all tax calculation, collection, and compliance as the Merchant of Record.

7. Intellectual Property

The Service, its design, documentation, and source code are our intellectual property. You retain ownership of any data you submit through the API. API responses generated by the Service (e.g., UUIDs, hashes, conversions) are not subject to IP claims by either party.

8. Availability and SLA

We strive to maintain high availability but do not guarantee 100% uptime. The Service is provided on a best-effort basis. We are not liable for downtime, data loss, or service interruptions. Scheduled maintenance will be announced when possible.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason with reasonable notice. You may stop using the Service and request account deletion at any time by contacting us.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the email associated with your API key or posted on this page. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator resides. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
